A valuation report is necessary to determine the value of a given land, flat or house. It is prepared by an appropriate entity meeting legal requirements.
A valuation report is regulated by the Act of 21st August 1997 on real estate management. According to the act, a property valuation is a procedure aimed at determining the property value. The valuation report sets a market value, a replacement value, a cadastral value and other values defined by the binding regulations. It may consider a land, a flat, a house or a commercial building. In case of any doubts concerning the reliability of the appraisal study, e.g. undervaluation, one may appeal to the Professional Liability Committee by the Polish Federation of Valuers’ Associations. The Committee will perform the analysis of the prepared document and declare it non-binding if it is inaccurate.
In accordance with the Act of 20th July 2017 amending the Act on real estate management, a person performing property valuation without professional qualifications in the field is subject to fine of PLN 50,000. A valuation report may be prepared only by a certified person with appropriate qualifications determined by Polish law, i.e.:
